1. Agreement to Terms
By downloading, installing, or using Fit Guild ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App. You must be at least 13 years old to use Fit Guild.
2. Description of Service
Fit Guild is a fitness application that generates personalized strength training workouts using recovery data, available equipment, and your preferences. The App integrates with Apple HealthKit to read health metrics for recovery and readiness calculations.
3. Health and Fitness Disclaimer
Fit Guild is not medical advice and is not a medical device. The App is intended for general fitness and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
The recovery scores, readiness estimates, workout recommendations, weight suggestions, and all other information provided by the App are based on general fitness principles and data you provide or authorize through Apple HealthKit. These are estimates only. Individual results vary. The App does not diagnose any medical condition and should not be relied upon for any medical purpose.
Always consult with a qualified healthcare provider before beginning any new exercise program, particularly if you have any pre-existing medical conditions, injuries, or concerns. If you experience pain, dizziness, shortness of breath, or any other concerning symptoms during exercise, stop immediately and seek medical attention.
4. Assumption of Risk
Physical exercise involves inherent and significant risks, including the risk of serious bodily injury or death. By using Fit Guild, you acknowledge that you are voluntarily participating in physical activities and you knowingly and freely assume all risks associated with such activities, whether known or unknown, including risks that may result from the negligence of Fit Guild or its developers.
You are solely responsible for determining whether any workout, exercise, weight, or intensity level is appropriate for your physical condition and fitness level. Fit Guild provides recommendations based on algorithms and data — it cannot assess your individual physical limitations, medical history, or current state of health.
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Fit Guild disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any content or data (including recovery scores, workout recommendations, or weight suggestions) will be accurate, reliable, or complete. You use the App at your sole risk.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Fit Guild, its developers, officers, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, death, loss of data, loss of profits, or other intangible losses, arising out of or related to your use of or inability to use the App.
In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the App exceed the amount you paid for the App in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
7. Indemnification
You agree to defend, indemnify, and hold harmless Fit Guild, its developers, officers, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any injury, harm, or damage arising from physical activities performed in connection with using the App.
8. Subscriptions and Payments
Fit Guild offers subscription plans managed entirely through Apple's App Store. By purchasing a subscription:
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate
- Free trials automatically convert to paid subscriptions unless canceled before the trial ends
- You can manage and cancel subscriptions in your Apple ID account settings
Refund requests are handled by Apple in accordance with their refund policies. We do not process payments or refunds directly.
9. User Data and Content
You retain ownership of the data you create within the App (workouts, logs, preferences, etc.). By using the App, you grant Fit Guild a limited license to process, store, and display your data solely for the purpose of providing and improving the App's functionality.
If you opt in to anonymized training data collection, you grant Fit Guild a perpetual, royalty-free license to use that anonymized, non-identifiable data to improve the App's algorithms and services. This data cannot be linked to you individually.
10. Account Responsibility
You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account. Fit Guild is not liable for any loss or damage resulting from unauthorized access to your account.
11. Acceptable Use
You agree to use Fit Guild only for its intended purpose as a fitness tracking and workout generation tool. You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Use the App for any unlawful purpose
- Redistribute, sell, or sublicense the App
- Remove any copyright or proprietary notices from the App
- Interfere with or disrupt the App's functionality
12. Intellectual Property
Fit Guild and all associated content, features, and functionality are owned by Fit Guild and protected by copyright, trademark, and other intellectual property laws. The App is licensed, not sold, to you for personal, non-commercial use.
13. Third-Party Services
Fit Guild integrates with Apple services including HealthKit, iCloud, Sign In with Apple, and StoreKit. Your use of these services is governed by Apple's terms and conditions. We are not responsible for the availability, accuracy, or functionality of any third-party services.
The App is licensed to you under these Terms and Apple's standard Licensed Application End User License Agreement (EULA). In the event of any conflict between these Terms and Apple's EULA, these Terms shall govern to the extent permitted by law. Apple has no obligation to provide maintenance, support, or warranty for the App.
14. Dispute Resolution
Please read this section carefully. It affects your legal rights.
You and Fit Guild agree that any dispute arising out of or related to these Terms or your use of the App shall first be resolved through good-faith informal negotiation. Contact us at support@fitguild.app with a description of the dispute. We will attempt to resolve it within 30 days.
Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis, and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Fit Guild.
15. Termination
You may stop using Fit Guild at any time by deleting the App. We reserve the right to terminate or suspend your access at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App. Sections 3 through 7 and 14 shall survive any termination of these Terms.
16. Modifications to Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Georgia, and you consent to the jurisdiction of such courts.
18. General Provisions
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fit Guild regarding your use of the App and supersede all prior agreements.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
